RUTTER’S PRIVACY POLICY

This Privacy Policy covers the data collection practices of Rutter’s Dairy and Rutter’s  Farm Stores, Inc. websites, www.rutters.com and www.ruttersrewards.com, and the Rutter’s Rewards mobile app  (collectively “Website”) operated by Rutter Farm Stores, Inc. (“Rutter’s,” “Company,” “we,” “us,” “our”). This Privacy Policy describes our privacy practices and those of our vendors and business partners on the Website. We are not responsible for the data collection practices of other companies or individuals that we do not own, control, employ, or manage.  When linking to another website or communicating with a Service Provider, you should read that site’s or Service Provider’s privacy policy.

We collect and use information from or about you according to the Privacy Policy in effect at the time the information is gathered.  Please be aware that our Privacy Policy may be changed at any time by updating this page.  Your continued use of the Service following any changes will mean you accept such changes.

INFORMATION WE COLLECT

Personally Identifiable Information

You do not have to give us personally identifiable information (“PII”) to visit our Website.  However, if you consent, we may collect and pass along your personal information to third party service providers (“Service Providers”), including GasBuddy and Advanced Marketing Solutions. Before you provide personal information about yourself on the Website, you should read the GasBuddy Privacy Policy regarding use of your personal information.  If you fill out a form on the Website, we may collect your:

  • First and last name
  • Physical address
  • Email address
  • Telephone number
  • Your comments
  • Your Rutter’s membership number and PIN
  • Your geo-location

Cookies

Depending on which Website you access, we or our Service Providers may collect and store cookies containing non-PII in log files on your browser or mobile app such as:

  • The domain and host from which you access the Internet
  • The IP address of the computer you use
  • Your browser software
  • The date and time you access the Website
  • UDID or RFID

CALIFORNIA DO NOT TRACK DISCLOSURES

(1) Rutter’s does not track Website visitors whose device or browser privacy settings’ are set to “do not track.” The Website will not override your privacy settings without your consent.

(2) Rutter’s authorizes certain Service Providers to collect PII and cookies from visitors to the Website with their consent.  Rutter’s authorized Service Providers may also track you across over websites and collect the following Non-PII in log files on your browser such as:

  • The Internet Protocol (IP) address of the website from which you linked to our Website
  • The website you visit after you leave the Website
  • The number of clicks you make on the Website
  • The geo-location of your mobile device

Canadian and European Union Users

We do not intend to collect PII from Canadian and European Union users.  If you are from the European Union or Canada, do not provide us with PII, use our Services, or the Website.  If we learn that we collected PII from a user from the European Union or Canada, we will promptly delete that information.

Children

This Website is intended only for adult use. We do not intend to collect PII from children.  If you are under the age of 18, do not provide us with PII, use our Website.  If we learn that we collected PII from a child, we will promptly delete that information. USE AND SHARING OF INFORMATION

All personal information volunteered in the Service is collected and stored by our Service Provider.  We do not retain any personal information on the Website. Our Service Provider uses your information to:

  • Provide access to the Service and to provide you with requested services and customer support and to process and respond to your inquiries
  • Personalize, customize, measure, and improve our services, content, and advertising and otherwise to enhance your experience of the Service
  • Prevent, detect, and investigate potentially prohibited or illegal activities, and enforce the Terms of Service
  • Analyze the accuracy, effectiveness, usability, or popularity of the Service
  • Generate and review reports and data about our user base and service usage patterns
  • Compile aggregate data for internal and external business purposes

  • Contact you with information, including promotional, marketing and advertising information and recommendations that we believe may be of interest to you

  • If you use the Service on a mobile device, with your consent, we may send push notifications to your mobile device to provide updates about the Website and other relevant messages. You can manage push notifications from the “Settings” page within your account. You may also be able to manage them from your mobile device’s settings page

If you do not wish to be contacted again by us or receive our notifications or emails, follow the unsubscribe instructions at the bottom of our emails or adjust your mobile app settings.

Service Providers 

We may share your information with third party contractors or Service Providers who provide certain services to us or on our behalf, such as operating and supporting the Website or otherwise responding to your customer service requests. These Service Providers will only have access to the information needed to perform these limited functions on our behalf and are required to provide your information with at least the same level of protection and security as we use for the Website.

Companies that Acquire Our Business or Assets

If we or Service Provider becomes involved in a merger, acquisition, sale of assets, securities offering, bankruptcy, reorganization, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we or Service Provider may share or transfer your information to a third party or parties in connection with the applicable transaction.

Our Affiliates

We or Service Provider may share information relating to visitors and users of the Website with affiliated or unaffiliated third parties on an aggregate basis. Law Enforcement Authorities

To the extent permitted by law, we may share your information with law enforcement, governmental agencies, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other Website user to legal liability, or to protect our rights or property, or during emergencies when safety is at risk.

HOW we protect and RETAIN your information

We and our Service Providers take security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data.  These include firewalls and encryption, internal reviews of our Service Providers’ data collection, storage and processing practices, and security measures, as well as physical security measures to guard against unauthorized access to systems.

We retain information for active user accounts as long as it is necessary and relevant for our operations. In addition, we may retain information from closed accounts to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce the Terms of Use and take other actions permitted by law. Correcting Your Personal Information

You may access and correct your personal information by accessing your user accounts on the Website or in the Rutter’s Rewards mobile App. 

Managing Email Communications

You can make changes regarding receiving email communications from us within your user account. You can also choose not to receive email communications from us by following the “unsubscribe” instructions in any email communication you receive from us.

This Rutter’s Rewards Mobile App Privacy Policy (“Mobile App Privacy Policy”) is an abbreviated privacy policy that covers the data collection practices of the Rutter’s Rewards mobile app (“Service”) operated by Rutter Farm Stores, Inc. (“Rutter’s,” “Company,” “we,” “us,” “our”). See Rutter’s full privacy policy here. This Privacy Policy does not cover the data collection practices of companies or individuals whom we do not own, control, employ, or manage. 

We and our Service Provider collect and use information from or about you according to the Privacy Policy in effect at the time the information is gathered. This Privacy Policy may be changed at any time by updating this page.  Your continued use of the Service following any changes will mean you accept such changes.

This Mobile App Privacy Policy, the full Privacy Policy and Terms together form the entire agreement between Rutter’s and you for use of the sites. (2) Rutter’s authorizes certain Service Providers to collect information from mobile app users with their consent. Rutter’s authorized Service Providers may also collect information from you in our retail stores and collect the following:

  • RFID or UDID
  • The number of clicks you make in the Service
  • The geo-location of your mobile device
  • Products that you purchase

To opt-out from collection and use of your information in the Service, adjust the privacy setting in your mobile app.

HOW WE USE AND SHARE INFORMATION

All personal information volunteered on the Website is collected and stored by our Service Provider GasBuddy who manages the Rutter’s Rewards program.  We do not retain any personal information on the Website. Our Service Providers use information to connect you to the Website, and provide services you request; to analyze trends, administer the website, track user movement, and gather broad demographic information.
